Sucker Brook Sub-Watershed 00:00:27

The City hired Colliers Engineering to complete a comprehensive hydrologic and hydraulic model analysis of the Sucker Brook sub-watershed. This study will determine peak flow rates during different size storms, evaluate bridges and channel reaches, develop concept level designs and solutions, evaluate potential homes for buyout due to their location and identify grant opportunities to complete projects. Colliers Engineering will provide an update on the draft report.


Tick-Borne Diseases 02:12:40

Councilmember Merrill requested that a presentation be made to the City Council and public related to the threat of tick-borne infections, such as Lyme Disease. Matt Hanggi, Communicable Disease Control Coordinator for Ontario County Public Health, will present data about the increasing amount of cases occurring within Ontario County.


Air Rights License: Ardor Park Artisanal Pizza 02:50:16

A new wood fire pizza business is planning to locate at 123 S. Main Street. They would like to install an exterior ventilation off the Phoenix Street façade which would be over the City’s sidewalk and utilize the City’s air rights. In order to accommodate this the City would need to grant a license. The basic terms of the license would be: - The City grants air space rights over the right-of-way, which is revocable at will by the City (potentially tied to compliance with codes, and compliance with special use permit and any other approvals.) - The license would be limited to the plans for the vent as already approved by the City Planning Commission in the special use permit. - Licensee agrees to indemnify and hold harmless the city from any claims relating to the license - It would be recorded; the business would need to pay for any recording fees.


Fireworks 02:53:05

The Town of Canandaigua is seeking to again partner with the City to celebrate Independence Day with a fireworks display. The Town has contracted with a fireworks company for fireworks on July 5th. To have a fireworks show off the shores of Kershaw Park, as we have traditionally done, the rental of a barge at a cost of $5,000 is required. The Town has requested that the City cover the costs of the barge and labor to staff the event, with the Town covering the cost of the fireworks display itself. A group of lakefront businesses has proffered to donate $5,000 to cover the cost of the barge. There are sufficient funds within the City’s budget to cover the cost of overtime for such an event. This item was added to ensure that the City Council is supportive of the City hosting and contributing towards a fireworks display.


Dumpster Time Limits 02:57:10

At the February 10th Finance Committee meeting, Councilmember Mills asked that we discuss dumpster time limits. A neighbor raised concern about a dumpster that another neighbor has had for many months related to a remodel project. The Committee directed staff to look into what other municipalities do to regulate dumpster time limits. Planning Director Rick Brown has prepared a memo for Council.


Prior Written notice local law 02:59:27

Chapter 16.2 of the City Charter, consistent with NYS General Municipal Law, details the City is not liable for damages or injuries unless there was a prior written notice and the City failed to remove the defect within a reasonable amount of time after such notice. As a result of the recent City of Albany litigation, it is recommended that a local law be adopted to specify what is considered written notification. After discussion during the March 3rd Ordinance Committee Meeting, Council requested David Hou draft amendments to our City Charter.
